Waivers

Repair Waiver - Pursuant to the provisions set forth in the Illinois Vehicle Emissions Inspection Law of 2005 (625 ILCS 5/13C-30) and 35 Ill. Adm. Code 276.401 and 276.403, if your vehicle has been tested at least twice, has been repaired, and has failed to comply with emissions inspection standards, you may be eligible for a Repair Waiver.

Exemptions & Extensions

Pursuant to the provisions set forth in the Illinois Vehicle Emissions Inspection Law of 2005 (625 ILCS 5/13C) and regulations at 35 Ill. Adm. Code Part 276, some vehicles selected for testing may be eligible for an exemption or extension from the requirement to test or retest.

Exemptions

The eligibility criteria and type of exemption are based primarily on the use (and by whom) or location of the vehicle.

  • Out of Area Exemption When a vehicle is located and primarily used outside of the Illinois vehicle emissions testing area and is located in a state/county where vehicle emissions testing is not required, the owner may request an Out of Area Exemption by submitting this application. If the vehicle is located in a state/county where vehicle emissions testing is required, this exemption is not applicable.   • Out of State Compliance When a vehicle is located and primarily used outside of the Illinois vehicle emissions testing area and is located in a state/county where vehicle emissions testing is required, the owner may submit reciprocal compliance with the Out of State Compliance application. Proof of a passing emissions test from the state where the vehicle is located must be submitted with this application. For a list of areas where emissions testing is required, click here.   • Sporting Activity Vehicle Exemption - A vehicle that is operated exclusively in organized amateur or professional sporting activities may apply for a Sporting Activity Vehicle Exemption. To learn more about and/or apply for a Sporting Activity Vehicle Exemption, click here.
  • Parade or Ceremonial Vehicle Exemption - A vehicle that is operated exclusively for parade or ceremonial purposes by a not-for-profit veterans, fraternal or civic organization may apply for a Parade or Ceremonial Vehicle Exemption. Extensions

  • Economic Hardship Extension - The owner of a vehicle that failed an emissions test and needs repairs that cannot be performed due to the owner’s/owners’ economic hardship, may apply for a one-year extension to allow additional time to get the vehicle repaired and either pass an emissions retest or receive a waiver.
